The internet chapter of the Anti-Counterfeiting Trade Agreement, a secret copyright treaty whose text Obama's administration refused to disclose due to "national security" concerns, has leaked. It's bad. It says:
* That ISPs have to proactively police copyright on user-contributed material. This means that it will be impossible to run a service like Flickr or YouTube or Blogger, since hiring enough lawyers to ensure that the mountain of material uploaded every second isn't infringing will exceed any hope of profitability.
* That ISPs have to cut off the Internet access of accused copyright infringers or face liability. This means that your entire family could be denied to the internet -- and hence to civic participation, health information, education, communications, and their means of earning a living -- if one member is accused of copyright infringement, without access to a trial or counsel.
* That the whole world must adopt US-style "notice-and-takedown" rules that require ISPs to remove any material that is accused -- again, without evidence or trial -- of infringing copyright. This has proved a disaster in the US and other countries, where it provides an easy means of censoring material, just by accusing it of infringing copyright.
* Mandatory prohibitions on breaking DRM, even if doing so for a lawful purpose (e.g., to make a work available to disabled people; for archival preservation; because you own the copyrighted work that is locked up with DRM)

anti-counterfitting -- trade agreement ? when my dad goes overseas to some place like Jakarta there he can buy copies, they may be the jerry seinfeld ' screeners' but they sell those recent released, non-dvd released, so .. i guess it's just ok if the stuff is bought overseas but u just cant get it through your service ...
because i dont think INTERPOL is doing much about it ..
and even 60 min. had a special on chinese copying how they let a trailer load go through and just dump out maybe one box of counterfitted stuff....

Great job Shelly. This strikes at the heart of the matter with "Corporatism" "Regulation" is sold as something that protects people but in reality it is used to protect businesses so that they continue to make money without innovating, and also, like this piece represents, to go around the Constitution and violate our liberty.
So this situation leads to two bad outcomes. An ISP like Comcast invading our privacy, and someone like me and I'm sure millions of others having no other broadband options other than Comcast.
If telecom wasn't so highly "regulated" billions of investment would pour into the space and there would be competition, better service, higher speeds, choice, and an overall increase in the standard of living.
The collusion of corporations with the government fills a few greedy pockets at the expense of the overall good of the nation.
I don't see why there shouldn't be a law against lobbying. There should be a firewall between Government and special interests.
But I'm so happy to have someone like you on our side!

By the way, isn't Comcast a government-granted monopoly? I can't get any other high-speed ISPs in my town, including Qwest. What's up with that?
